Do You Have a Slip and Fall Claim in Mission Viejo?
A Mission Viejo slip and fall lawyer can help you recover if you were hurt by an unsafe condition on someone else’s property in Mission Viejo, such as a spill, broken step, or uneven walkway, and the owner knew or should have known about it and failed to fix it or warn you.
The Law Offices of Faud Haghighi represents people injured in falls in Mission Viejo, throughout South Orange County, and across Southern California, from our nearby Aliso Viejo office at 120 Vantis, Suite 300. Attorney Faud Haghighi has practiced law in California since 2012 and has handled hundreds of injury cases, including premises liability cases and claims against cities for dangerous conditions of public property. Our recoveries include $400,000 for a client injured in a slip and fall on public property in Anaheim. Results depend on the facts of each case and will differ if based on different facts.
Who Is Responsible for a Slip and Fall in Mission Viejo?
Responsibility depends on who controls the spot where you fell. A store usually controls its own floors, a mall owner or manager usually controls common areas and parking, an HOA controls community common areas, and the city controls public sidewalks and facilities. Under Civil Code §1714, each must use ordinary care in managing its property, and leases and maintenance contracts can shift that responsibility.
| Where you fell | Who may be liable | Key rule |
|---|---|---|
| Inside a store or restaurant | The business or tenant | Ordinary care (Civil Code §1714); notice of the hazard |
| Mall common areas and parking, such as The Shops at Mission Viejo | The mall owner or management company | Depends on control of the area and the lease terms |
| HOA common areas | The homeowners’ association and possibly its management or maintenance contractor | The association’s governing documents set who maintains what |
| Apartment common areas | The landlord or property manager | Ordinary care; repairs of known hazards |
| City sidewalks, parks, and facilities | The City of Mission Viejo | Gov. Code §§835 and 911.2: written claim within six months |
How Is Liability Proven?
You generally must show that a hazardous condition existed, that the owner knew or should have known about it, and that they failed to fix it or warn you in time. Key questions include how long the hazard was there, whether routine inspections were done, and whether similar problems were reported before. Evidence that a store did not inspect the area within a reasonable time before the fall can allow a jury to infer it should have discovered the hazard (Ortega v. Kmart Corp. (2001) 26 Cal.4th 1200). Surveillance footage, maintenance logs, incident reports, and witness statements are often decisive. Read more about proving notice of a dangerous condition.
What If You Fell on City or Other Public Property?
If a dangerous condition on City of Mission Viejo property caused your fall, a written claim is generally due within six months (Government Code §911.2), much sooner than the usual two-year deadline. Claims go to the City Clerk at 200 Civic Center, Mission Viejo, CA 92691, by mail, in person, or by email to claims@cityofmissionviejo.org (949-470-3052). To recover, you must show the condition was dangerous and that the city created it or had notice of it in time to fix it (Gov. Code §835). Cities often argue that a small crack or height difference is a “trivial defect” that is not legally dangerous (Gov. Code §830.2), so photograph and measure the defect before it is repaired. Learn more on our Dangerous Conditions of Public Property page and our guide to sidewalk and walkway falls.
Where Do Slip and Fall Accidents Happen in Mission Viejo?
Falls in Mission Viejo commonly happen in shopping centers, grocery stores and restaurants, apartment complexes and HOA common areas, parking lots, and on public sidewalks. The Shops at Mission Viejo and the commercial corridors along Crown Valley Parkway, Marguerite Parkway, and Alicia Parkway draw heavy foot traffic, and much of the city is made up of planned communities with association-maintained common areas. Lake Mission Viejo, for example, is run by a private homeowners’ association for its members and their guests.
- Shopping centers and retail stores and grocery stores with spills or cluttered aisles
- Restaurants and cafés with wet floors or poorly maintained surfaces
- Apartment complexes and HOA common areas with uneven walkways or damaged stairs
- Parking lots and garages with poor lighting or broken pavement
- Medical and office buildings with unsafe entryways or stairwells

What Causes Most Slip and Fall Accidents?
Most falls come from preventable hazards that weren’t fixed in time:
- Wet or recently cleaned floors without warning signs
- Uneven or damaged sidewalks, walkways, and flooring (see our trip and fall page)
- Poor lighting in walkways, stairs, and parking areas
- Loose rugs, curled mats, or debris
- Broken handrails, steps, or entryways
What If You Were Partly at Fault for the Fall?
You can still recover. California’s pure comparative negligence rule (Li v. Yellow Cab Co., 1975) reduces your recovery by your share of fault but does not bar the claim. If your damages are $100,000 and you are found 20% at fault, you recover $80,000. Insurers often argue you should have seen the hazard or were distracted; footage, missing warning signs, and inspection records help keep your share of fault as low as the evidence allows.
How Long Do You Have to File a Slip and Fall Claim?
Most California personal injury lawsuits must be filed within two years of the injury (CCP §335.1). Falls on public property require a written government claim, generally within six months (Gov. Code §911.2). If the injured person is under 18, the two-year lawsuit deadline generally does not start until age 18 (CCP §352), but the six-month government claim rule still applies. Evidence such as surveillance video can be overwritten much sooner, so act early.
What Should You Do After a Slip and Fall in Mission Viejo?
Get medical care, report the fall, photograph the hazard, collect witness information, and ask that video be preserved.
- Get medical attention. Call 911 for serious injuries. Providence Mission Hospital in Mission Viejo is a Level II adult and pediatric trauma center serving South Orange County. Prompt records connect your injury to the fall.
- Report the incident to the store, property manager, landlord, or HOA and ask for a written incident report.
- Photograph the hazard, the area around it, your shoes, and your injuries before anything is cleaned or repaired.
- Collect witness names and phone numbers, including employees who saw the fall.
- Avoid discussing fault or giving a recorded statement to an insurer before getting legal advice.
What Injuries Commonly Result From Slip and Falls?
Common injuries include fractures (especially wrists, hips, and ankles), head injuries and concussions, back and spinal injuries, and torn ligaments. Some people need surgery or long-term care, and some injuries limit the ability to work. Seeing a doctor promptly and following the treatment plan protects both your health and your claim; gaps in care are often used to argue an injury was minor.
What Compensation Can You Recover?
A slip and fall claim can include medical care and future treatment, lost income and reduced earning capacity, pain and suffering, and emotional distress.
- Medical care, rehabilitation, and future treatment needs
- Lost income and reduced earning capacity
- Pain and suffering
- Emotional distress and loss of enjoyment of life
Value depends on the severity of the injury, the length of treatment, the strength of the notice evidence, any share of fault, and the insurance available. Read more about what affects the value of a personal injury case.
Where Would Your Case Be Filed?
Personal injury lawsuits from Mission Viejo are filed in the Orange County Superior Court, where civil cases are heard at the Central Justice Center, 700 Civic Center Drive West, Santa Ana. The Harbor Justice Center in Newport Beach serves Mission Viejo for traffic and criminal matters, not injury lawsuits. Most cases settle before trial, and your attorney handles the filings.
How Does a Mission Viejo Slip and Fall Lawyer Build Your Case?
We move quickly to preserve the evidence the property owner controls, then prove notice and causation with records the defense can’t explain away. That means written preservation demands for video and inspection logs, witness interviews, documentation of your injuries, all communication with the insurers, negotiation, and filing suit when an insurer won’t be reasonable. You work directly with your attorney, and we work on contingency, so there is no attorney fee unless we recover for you. Each result depends on the facts of that case, and results will differ if based on different facts.
Where Do You Serve Slip and Fall Clients?
In addition to Mission Viejo, we represent fall victims throughout Orange County and Southern California, including Aliso Viejo, Laguna Niguel, Laguna Hills, Lake Forest, Irvine, Santa Ana, Costa Mesa, Newport Beach, and Anaheim. Mission Viejo Slip and Fall FAQs
It depends on where you fell. A store usually controls its own floors, while the mall owner or management company usually controls common areas, walkways, and parking. Leases and maintenance contracts can shift that responsibility, so we identify every party that controlled the area.
Possibly. Homeowners’ associations generally must use reasonable care in maintaining the common areas they control, such as walkways, stairs, and pool decks. The association’s governing documents show who maintains a given area.
The lake is run by the Lake Mission Viejo Association, a private homeowners’ association, for its members and their guests. A claim would usually be against the association or a contractor responsible for the area, not the City.
Possibly, under Government Code §835, if the sidewalk was in a dangerous condition and the city created it or knew or should have known about it in time to fix it. A written claim is generally due within six months and is filed with the City Clerk at 200 Civic Center or by email to claims@cityofmissionviejo.org, so get advice right away.
Generally two years from the injury for falls on private property (CCP §335.1). For falls on public property, a written government claim is generally due within six months (Gov. Code §911.2).
You can still recover. Under California’s pure comparative negligence rule, your recovery is reduced by your share of fault but not barred.
Photos of the hazard and the surrounding area, the names and phone numbers of witnesses, a copy of the incident report, your shoes as they were, and your medical records. Ask the business in writing to preserve its surveillance video, which can be overwritten within days or weeks.
Not automatically. The store’s liability insurance pays when the store is legally responsible for the fall. Some policies include limited medical payments coverage regardless of fault. Your own health insurance can cover treatment while the claim is pending.

It depends on the severity of your injury, your medical bills and lost income, any lasting limitations, how strong the notice evidence is, and the insurance available. No one can give an honest number before reviewing the facts.
Get medical care, report the fall to the property owner or manager, photograph the hazard, and ask that video be preserved. Then talk to a lawyer before giving any recorded statement to an insurer.
Nothing up front. We work on contingency, so there is no attorney fee unless we recover for you, and the consultation is free. If there is no recovery, you owe no attorney fee, but you may still be responsible for case costs, as explained in your fee agreement.
