How Can an Orange County Uber Accident Lawyer Help?

An Orange County Uber accident lawyer works out which insurance policy applies at the moment of the crash, which depends on what the driver’s app showed, and pursues the rideshare company’s coverage, which can reach $1 million, along with any other policy that pays for your injuries.

Uber and Lyft crashes raise a question ordinary car accidents don’t: was the driver offline, waiting for a ride, or carrying a passenger? The answer decides whose insurance pays and how much is available. The Law Offices of Faud Haghighi represents rideshare passengers, other drivers, pedestrians, cyclists, and rideshare drivers throughout Orange County and Southern California from offices in Aliso Viejo and Tustin. Faud Haghighi’s practice centers on cases with multiple parties and disputed liability, and he handles each case personally.

Rideshare claims at a glanceWhat it means for you
App status decides coverageOffline, waiting for a request, or on a trip: each triggers different insurance.
Up to $1 millionFrom the moment a ride is accepted until it ends, rideshare coverage must be at least $1 million.
PassengersPassengers are rarely at fault and can generally claim against whichever driver caused the crash.
Proof disappearsTrip screenshots and app records should be saved and requested early.
FeesFree, confidential consultation. No attorney fee unless we recover for you.

What Should You Do After an Uber or Lyft Accident?

Get medical care, then capture proof of the ride and the driver’s app status before it disappears.

  1. Get medical attention and keep every record.
  2. Call the police and get the report number.
  3. Screenshot the trip in your app: the driver’s name, vehicle, route, and time. If you were in another car, note the rideshare sticker on the windshield.
  4. Ask the rideshare driver whether the app was on and whether they had accepted a ride, and write down what they say.
  5. Report the crash through the app, but keep it short and factual.
  6. Get information from every driver involved and any witnesses.
  7. Don’t give a recorded statement to the rideshare company’s insurer or any other insurer before getting advice.

Which Insurance Covers an Uber or Lyft Crash?

California sets the required rideshare insurance by the driver’s app status. From the moment a driver accepts a ride until the ride ends, coverage must be at least $1 million (Pub. Util. Code §5433).

Driver’s app status at the time of the crashRideshare insurance required by California law
App off (driving for personal reasons)None from the rideshare company; the driver’s personal auto policy applies
App on, waiting for a ride requestAt least $50,000 per person and $100,000 per incident for injuries, $30,000 for property damage, plus at least $200,000 in excess coverage
Ride accepted, driving to the pickup, or carrying a passenger$1,000,000 primary coverage for injury, death, and property damage
Passenger in the car and the at-fault driver is uninsured or underinsuredUninsured/underinsured motorist coverage from the rideshare company of $60,000 per person and $300,000 per incident while the passenger is in the vehicle

Personal auto policies often exclude coverage while a driver is working for a rideshare company, so the app status at the exact moment of impact is frequently disputed.

How Is the Driver’s App Status Proven?

With records, not memory. Insurers sometimes argue a driver was offline, or only waiting for a request, to avoid the higher coverage. The evidence that settles it includes:

  • The passenger’s trip receipt and in-app screenshots showing the driver, vehicle, route, and times.
  • The rideshare company’s trip and app-status records, requested early and obtained through the claim or a lawsuit.
  • What the driver told police, the other drivers, or witnesses at the scene.
  • The rideshare sticker on the windshield, the collision report, and photos of the vehicles.
  • The driver’s phone use, which can also show distraction while watching the app.

We match those records to the time of the crash, then pursue the policy that applied at that moment.

Who Can File a Claim After a Rideshare Crash?

Anyone hurt by a negligent driver, including rideshare passengers, people in other cars, pedestrians, cyclists, and the rideshare driver.

  • Passengers can generally claim against whichever driver caused the crash: the rideshare driver, the other driver, or both.
  • Other drivers, pedestrians, and cyclists hit by a rideshare driver can claim against the coverage that applied to the driver’s app status; see pedestrian and bicycle accident claims.
  • Rideshare drivers hurt by another driver can claim against that driver. While online, they are also covered by the occupational accident insurance rideshare companies must provide under Proposition 22, including at least $1 million for medical expenses and partial wage replacement (Bus. & Prof. Code §7455).

If you share part of the fault, California’s comparative negligence rule reduces your compensation instead of barring it. A driver with $70,000 in losses who is found 30% at fault still recovers $49,000.

Are Uber and Lyft Themselves Responsible?

Under Proposition 22, which the California Supreme Court upheld in 2024, app-based drivers are treated as independent contractors when the law’s conditions are met (Bus. & Prof. Code §7451). In practice, most injury claims are paid through the insurance the rideshare company is required to carry for its drivers rather than by suing the company for the driver’s conduct. Other claims against the company itself depend on the facts.

Where Do Rideshare Crashes Happen in Orange County?

Rideshare crashes happen wherever drivers make frequent pickups, quick stops, and sudden turns:

  • John Wayne Airport, where drivers circle, merge, and stop for pickups and drop-offs.
  • The Anaheim Resort area, with heavy visitor traffic and constant curbside stops.
  • Downtown districts and nightlife areas, where drivers pull over, make U-turns, and passengers open doors into traffic.
  • Freeways and arterials such as the I-405 and the I-5, where watching the app instead of the road leads to rear-end and lane-change crashes.

What Affects the Value of an Uber or Lyft Accident Claim?

A claim can include medical bills and future care, lost wages and earning capacity, pain and suffering, and property damage, and the $1 million rideshare coverage can make more insurance available than in an ordinary crash. There is no reliable “average Uber accident settlement”; these factors usually move value:

Can increase valueCan complicate or reduce recovery
Serious injury and future careA dispute over the driver’s app status
Proof the driver was on a trip or en route to a pickupSeveral insurers pointing at each other
Substantial lost incomeGaps or delays in treatment
Clear evidence of faultShared fault

Past medical expenses are generally measured by what was actually paid or owed. Read more about what affects the value of a personal injury case and the insurance adjuster’s role.

How Long Do You Have to File an Uber or Lyft Accident Claim?

Generally two years from the crash to file an injury lawsuit, the same as other car accidents, with a shorter deadline when a public agency is involved.

SituationDeadlineLaw
Injury lawsuit against the at-fault driver(s)2 years from the crashCCP §335.1
Vehicle and property damage3 yearsCCP §338

How Does Faud Haghighi Sort Out Which Rideshare Policy Applies?

Rideshare cases often involve two or three insurers pointing at each other. Faud Haghighi has practiced law in California since 2012, has resolved cases against insurance carriers and large corporate defendants, and handles each case personally. We secure the trip records and app data, match them to the moment of the crash, identify every policy that applies, and press the insurers to pay. If they won’t, we file in the Orange County Superior Court.

We represent rideshare crash victims throughout Orange County and Southern California, including Irvine, Newport Beach, Costa Mesa, Anaheim, Santa Ana, and Huntington Beach, as part of our Orange County personal injury practice. If the other driver had little or no insurance, see uninsured motorist claims.

Orange County Uber & Lyft Accident FAQs

From the moment the driver accepts your ride until it ends, California requires $1 million in rideshare insurance for injuries caused by the rideshare driver (Pub. Util. Code §5433). If another driver caused the crash, that driver’s insurance is also responsible.

When the app is on but no ride has been accepted, California requires at least $50,000 per person and $100,000 per incident in injury coverage, $30,000 for property damage, and $200,000 in excess coverage. The driver’s personal policy may also come into play.

Then the rideshare company’s insurance generally doesn’t apply, and the claim goes against the driver’s personal auto policy, like any other car accident. Proof of app status, such as trip records, is often what decides this.

While a passenger is in the vehicle, rideshare companies must provide uninsured and underinsured motorist coverage of $60,000 per person and $300,000 per incident. Your own UM/UIM coverage may also apply.

Usually the claim is paid through the insurance the company must carry for its drivers. Under Proposition 22, drivers are generally treated as independent contractors, so claims against the company itself for the driver’s conduct are limited and depend on the facts.

If another driver caused the crash, you can claim against that driver’s insurance. While you’re online, Proposition 22 also requires the company to provide occupational accident insurance with at least $1 million for medical expenses and partial wage replacement.

Screenshots of the trip in the app, the driver’s name and vehicle, receipts, photos of the scene and injuries, the police report number, and witness contacts. If you were the other driver, note any rideshare sticker on the car.

Often, yes. Your health insurance or MedPay coverage may pay medical bills while the claim moves forward, and they may be reimbursed from the recovery. We review those liens so you keep as much of the recovery as possible.

Ask for proof. App data, trip logs, and the driver’s own statements can show the status at the moment of the crash. Insurers sometimes dispute this to avoid the higher coverage, which is why we request the records early.

You can claim against the coverage that applied to the driver’s app status: the driver’s personal policy if the app was off, the rideshare company’s coverage if the app was on, and $1 million if a ride had been accepted. Your own uninsured/underinsured motorist coverage may also help if the limits are too low.

Generally two years from the crash to file an injury lawsuit (CCP §335.1), three years for property damage alone, and six months for a written claim if a public agency is involved.

Nothing up front. We work on a contingency fee, so there is no attorney fee unless we recover compensation for you, and the consultation is free.
